Canadian Work Permit 2023

To work in Canada, most foreign nationals require a work permit. A work permit is a legal document that allows a foreign national to work while in Canada. Every year, Canada issues around 500,000 work permits to temporary foreign workers from all over the world. There are basically 2 types of work permits.

1. Employer-specific work permit

An employer-specific work permit allows you to work in Canada in accordance with the conditions of your work permit, such as

  • the name of the exact employer for whom you can work
  • how long you can work
  • where you can work (if applicable)

Your employer must give you the following documents before you apply for an employer-specific work permit.

  • a copy of your employment contract
  • 1 of the following:
    • a copy of a labour market impact assessment (LMIA)
    • an offer of employment number (for LMIA-exempt workers)
If your employer is exempt from using the Employer Portal
If your employer does not need to use the Employer Portal to make job offer, they must provide you with copy of the employment contract.

2. Open work permit

You may be eligible for an open work permit If you are:
  • Spouse, common-law partner, or dependent child of a work permit holder who works in any Training, Education, Experience, and Responsibilities (TEER) category (0 to 5), or who is the primary applicant and has an open work permit (example: post-graduation work permit holders at all skill levels)
  • spouse, common-law partner, or dependent child of a work permit-holding economic classes permanent resident application

Who is not eligible at this time

Spouses and dependents of employees in TEER 4 or 5 jobs under the Seasonal Agricultural Worker Program’s low-wage stream and the Agricultural Stream of the Temporary Foreign Worker Program are not eligible at this time.

An open work permit allows you to work for any employer in Canada, except for one that

  • is included on the list of employers who have failed to comply with the restrictions as ineligible, or
  • regularly offers striptease, erotic dance, escort services or erotic massages

Canadian Work Permit Requirements for all applicants

When applying for a work visa, you must fulfill various requirements depending on where you are so you can work in Canada for foreigners.

However, regardless of where you apply or the type of work permit you want, you must

  • prove to an official that you intend to leave Canada after your work permit expires;
  • prove that you have sufficient funds to support yourself and your family members throughout your stay in Canada and return home;
  • observe the law and have no criminal history (may request a police clearance certificate);
    not endanger Canada’s security
  • be in excellent health and, if necessary, get a medical checkup
  • not intend to work for an employer included on the list of employers that failed to comply with the requirements with the status “ineligible”;
  • Not intend to work for an employer who regularly offers striptease, erotic dancing, escort services, or erotic massages;
  • provide the officer with any other documents requested to show your eligibility to enter the country.

A visa, also known as a temporary residence visa (TRV), is a physical sticker that is placed in your passport and serves as a travel document that allows foreign individuals to enter Canada or transit through a Canadian airport.

Even if you have a valid work permit, you cannot return to Canada without a valid visa or eTA.

Do I need IELTS to apply for a Canadian work permit?

How long are Canadian work permits valid?

Canadian Work permits are normally valid for 1-2 years, with certain exceptions. A visa officer will often not grant a work permit for a period of time that exceeds the validity of an applicant’s passport or the period of time stated in the applicant’s Labour Market Impact Assessment (LMIA). A work permit will also not be provided for any period of time longer than the foreign national has applied to stay in Canada, or beyond the duration of time that is necessary for the employment offer. Can my employer sponsor me to work in Canada?

Employers in Canada do not “sponsor” candidates to work in Canada, but they can help bring in foreign workers by securing a Labour Market Impact Assessment (LMIA) or submitting an electronic job offer (LMIA exempted categories).

Any Canadian employer that desires to employ a foreign worker must first obtain an LMIA or submit an electronic job offer. An LMIA or “A” number (electronic job offer) obtained by an employer can be used to apply for a Canadian work visa.
